Agreement to Terms

By accessing or using the Perfume Identifier website (perfumeidentifier.com) and the Scentra mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by Scentra ("we," "us," or "our").

Description of Service

Perfume Identifier and Scentra provide AI-powered perfume identification, fragrance recommendations, a scent quiz, an AI fragrance advisor, a perfume dupe finder, and a fragrance catalog. The Service is designed for informational and personal use. Features may change, be updated, or be discontinued at our discretion.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

User Accounts

Some features may require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Upload or transmit harmful, offensive, or infringing content.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
• Use automated tools to scrape, crawl, or extract data from the Service without permission.
• Interfere with or disrupt the Service or servers.
• Use the Service to promote counterfeit or illegal products.

AI-Generated Content

The Service uses artificial intelligence to identify perfumes, generate recommendations, and provide fragrance advice. AI-generated results are provided for informational purposes and should be treated as suggestions, not definitive assessments. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. Users should verify important information independently and test fragrances in person before purchasing.

Intellectual Property

All content, features, and functionality of the Service, including text, graphics, logos, icons, images, software, and the underlying AI models, are owned by Scentra or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

User Content

By submitting content to the Service (including photos, quiz responses, and chat messages), you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze that content for the purpose of providing and improving the Service. You retain ownership of your content. We will not use your photos for advertising without your explicit consent.

Third-Party Content and Links

The Service may reference third-party brands, products, and trademarks. All third-party trademarks are the property of their respective owners. References to specific perfume brands and products are for identification and informational purposes only. The Service may contain links to third-party websites; we are not responsible for their content or practices.

Purchases and Subscriptions

Some features may require a paid subscription. Subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions. Pricing, billing cycles, and refund policies are governed by the App Store. You can manage or cancel subscriptions through your Apple ID settings.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of perfume identifications, recommendations, or AI-generated advice. Use of the Service is at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Scentra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages related to purchasing decisions made based on AI recommendations. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Scentra and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in accordance with the dispute resolution procedures outlined below.

Dispute Resolution

If informal resolution is not possible, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
